Please read these Terms carefully before using the Overlander app or website. By accessing or using our service, you agree to be bound by these Terms. If you do not agree, please do not use Overlander.

1. Acceptance of terms

These Terms of Service ("Terms") form a legally binding agreement between you and Adventure Together, Inc. ("Company", "we", "us"). They govern your use of the Overlander mobile application, website at www.overlander.app, and all related services (collectively, the "Service").

2. Use of the service

You must be at least 13 years old to use Overlander. By using the Service, you represent that you meet this requirement. You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Service.

3. User accounts

To access most features, you must create an account. You are responsible for:

  • Keeping your login credentials confidential.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorised use at support@overlander.app.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Prohibited conduct

You agree not to:

  • Use the Service to harass, threaten, or harm others.
  • Share false or misleading location information in a way that could endanger other users.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Reverse-engineer, decompile, or disassemble any part of the app.
  • Use the Service in any way that could disable, overburden, or impair it.
  • Use automated tools to scrape or access the Service without written permission.

5. Location and safety

Overlander includes features that share your GPS location with other users in your trip group. You are solely responsible for:

  • Deciding who you share your location with.
  • Your own safety during off-road and wilderness travel.
  • Carrying appropriate emergency equipment and informing others of your plans through official channels (e.g. filing a trip plan with local authorities where required).

Overlander is a tool to assist — it is not a substitute for good judgement, proper equipment, or emergency services.

6. Intellectual property

The Overlander name, logo, app design, and all content created by Adventure Together, Inc. are the exclusive property of the Company and are protected by copyright, trademark, and other laws. You may not use our intellectual property without prior written consent.

Content you create within the app (trip plans, routes, notes) remains yours. By using the Service, you grant us a limited, non-exclusive licence to store and process that content in order to provide the Service.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected. Use of the Service — particularly in remote, off-road, or wilderness environments — is at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, Adventure Together, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to personal injury, property damage, or loss of data that results from off-road or wilderness activities.

9. Governing law

These Terms are governed by the laws of the State of TX, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of TX.

10. Changes to these terms

We may revise these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
